Welcome to 24e Health Clubs (“24e Health Clubs,” “we,” “us,” or “our”). By accessing our website (www.24ehealthclubs.com), using our facilities, or participating in our services, you agree to these Terms of Service (“ToS”). If you do not agree, please do not use our website, facilities, or services.
1. Acceptance of Terms
By using our services or facilities, you confirm that you are at least 19 years of age (Alabama’s age of majority) or have parental/guardian consent if aged 16–18. These ToS govern your use of our website, membership, and access to our facilities in Birmingham, Hoover, Pelham, Huntsville, Trussville, and Gardendale.
2. Membership and Services
2.1 Eligibility
Members must be at least 19 or have parental consent (ages 16–18). Minors under 16 may only use facilities under direct parental supervision.
2.2 Membership Agreement
Membership is subject to a separate written agreement, compliant with Ala. Code § 8-23-4, specifying fees, duration, and cancellation rights. You will receive a copy of the agreement at signing.
2.3 Membership Types
- Regular Membership: Includes 24-hour access, use of equipment, and standard amenities.
- Premium Membership: Includes all Regular Membership benefits plus small group training, swim coaching (Pelham only), monthly InBody scans, nutritional guides, childcare, tanning, towel service, and discounts on smoothies/merchandise.
- Additional services (e.g., locker rentals, towel service, tanning, childcare) incur separate fees at select locations, unless covered by a Premium Membership.
2.4 Guest Policy
Guests must pay a fee, sign a liability waiver, and comply with facility rules. Guests under 19 require parental consent.
2.5 Services
We offer group fitness classes (e.g., yoga, cycling), personal training, and amenities like free Wi-Fi. Services vary by location and are subject to change.
3. Use of Facilities
3.1 Rules and Regulations
You must follow posted rules, including dress code, equipment use, and conduct. 24-hour access is available at select locations via barcode scanning after staffed hours (e.g., Huntsville: Mon-Fri 6 AM–9 PM, Sat 9 AM–6 PM, Sun 1 PM–6 PM).
3.2 Health and Safety
You confirm you are physically capable of using our facilities and assume all risks of injury. Consult a physician before exercising.
3.3 Prohibited Conduct
Harassment, vandalism, or illegal activities (e.g., drug use) are prohibited and may result in membership termination.
4. Website Use
4.1 Access
Our website provides information on memberships, schedules, and account management. We do not guarantee uninterrupted access.
4.2 User Accounts
You are responsible for securing your account credentials and notifying us of unauthorized use.
4.3 Prohibited Uses
You may not use the website for illegal purposes, to transmit harmful code, or to infringe on others’ rights.
5. Payments and Billing
5.1 Fees
Membership and service fees are outlined in your membership agreement. Fees for additional services (e.g., locker rentals, towel service) are charged separately.
5.2 Billing Disputes
Disputes must be reported within 30 days of the charge, or you waive the right to dispute.
5.3 Late Fees
Late payments may incur fees as specified in your agreement, per Alabama law.
6. Cancellation and Termination
6.1 Cooling-Off Period
Per Ala. Code § 8-23-4, you may cancel your membership within three (3) business days of signing the agreement for a full refund. Notice must be delivered in writing to the facility or via email to support@24ehealthclubs.com. NOTICE: YOU MAY CANCEL THIS CONTRACT BY DELIVERING WRITTEN NOTICE WITHIN THREE (3) BUSINESS DAYS FROM THE DATE OF SIGNING.
6.2 Member Cancellation
After the cooling-off period, cancellations follow the terms of your membership agreement. Submit requests in writing or via our online portal.
6.3 Termination by 24e Health Clubs
We may terminate your membership for non-payment, violation of rules, or conduct detrimental to our business.
7. Liability and Waiver
7.1 Assumption of Risk
You acknowledge that fitness activities involve risks of injury or death and assume all such risks.
7.2 Liability Waiver
To the fullest extent permitted by Alabama law, 24e Health Clubs, its affiliates, and agents are not liable for injuries, damages, or losses from facility use.
7.3 Property Loss
We are not responsible for lost, stolen, or damaged personal property.
8. Intellectual Property
All website content, including logos and class schedules, is owned by 24e Health Clubs or its licensors and protected by copyright and trademark laws. Unauthorized use is prohibited.
9. Privacy Policy
Your personal information is handled per our Privacy Policy, available at www.24ehealthclubs.com/privacy-policy. By using our services, you consent to data collection and use as described.
10. Governing Law and Dispute Resolution
10.1 Governing Law
These ToS are governed by Alabama law, per Ala. Code § 8-23-1 et seq.
10.2 Arbitration
Disputes will be resolved through binding arbitration in Birmingham, Alabama, under American Arbitration Association rules. You waive class action rights.
11. Changes to Terms
We may update these ToS by posting revisions on our website. Continued use constitutes acceptance.
